Crowwoods.com Screensavers Terms of Use

You may use this screensaver only as described in this license.

1. Screensaver

The capitalized term "Screensaver" used below refers to Crow Woods screensavers, any associated components, any related media and printed materials, and any "online" or electronic documentation.

2. Rights Granted

This Agreement allows you to use the Screensaver. You are granted a nonexclusive, nontransferable license permitting you to download the Screensaver solely for your personal use. The rights granted to you by Crow Woods Publishing shall not be assigned, sublicensed or otherwise conveyed or transferred by you to any other person, organization or entity. Any rights not expressly granted to you herein by Crow Woods are reserved.

3. Privacy Policy

You acknowledge and agree that you have reviewed, understand, and agree to be bound by all of the terms and provisions of the Crow Woods Privacy Policy for the Screensaver you are downloading. Your use of the Screensaver is expressly conditioned upon such acknowledgment and agreement.

4. General Restrictions

You may not make or distribute copies of the registered Screensaver, or electronically transfer the Screensaver from one computer to another or over a network. You may not decompile, reverse engineer, disassemble, or otherwise reduce the Screensaver to a human-perceivable form. You may not modify, sell, rent, transfer, resell for profit, distribute or create derivative works based upon the Screensaver or any part thereof.

5. Ownership

The foregoing license gives you limited rights to use the Screensaver. You do not become the owner of the Product. Provider and its suppliers retain title to the Product and all copies thereof. All rights not specifically granted in this Agreement, including Federal and International Copyrights, are reserved by Crow Woods. You acknowledge and agree that Crow Woods holds all rights to, title to and interest in all tangible and intangible incidents of the Screensaver, including all patents, copyrights and trade secrets pertaining thereto, and that this Agreement conveys to you only a limited right to access and use the Screensaver. All rights to the artwork used in the Screensavers are retained by the individual artists.

6. Disclaimer of Warrantees and Technical Support

THE SCREENSAVER IS PROVIDED TO YOU ON AN "AS IS" BASIS, WITHOUT ANY WARRANTY OF ANY KIND FROM CROW WOODS. CROW WOODS IS PROVIDING THE SCREENSAVER WITHOUT ANY WARRANTIES OR REPRESENTATIONS OF ANY KIND INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF THE TRADE.

THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SCREENSAVER -- INCLUDING RESPONSIBILITY FOR ANY DAMAGES CAUSED BY ERRORS, INACCURACIES OR OMISSIONS, COMMUNICATIONS LINE INTERRUPTION OR FAILURE, UNAUTHORIZED ACCESS, THEFT, SYSTEMS FAILURE AND OTHER OCCURRENCES BEYOND CROW WOODS' CONTROL -- IS BORNE BY YOU. CROW WOODS SHALL IN NO WAY BE RESPONSIBLE FOR ANY DAMAGES CAUSED TO YOUR COMPUTER HARDWARE, DATA OR SYSTEM OR TO ANY DATA ON YOUR SYSTEM ARISING FROM THE DOWNLOAD AND/OR USE OF THE SCREENSAVER.

7. Limitation of Damages

CROW WOODS SHALL NOT BE LIABLE TO YOU OR ANY OTHER THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LOSS (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LOSS OF DATA, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF PROVIDER OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES ARISING FROM OR RELATED TO THIS AGREEMENT OR THE PRODUCT.

8. Termination

This license terminates if you fail to comply with its terms and conditions. If your license terminates, you must destroy all copies of the Screensaver you have. The termination of this license does not limit Crow Woods’ other rights it may have by law.

This Agreement shall be governed by the internal laws of the State of Illinois. This Agreement contains the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
